THE MEDIATION PROCESS

If all parties agree to explore the possibility of resolving their dispute, they may participate in mediation, which is a voluntary and confidential process that is separate from any court proceedings.

After initial information is provided by the parties, we will confirm there are no conflicts of interest that would prevent us from providing mediation services. Following this confirmation, we will provide information about our costs and mediation policies to the parties for consideration.

The parties decide on the mediation format (online or in-person) and the specifics of pre-mediation submissions. Upon receipt of a signed retention agreement along with any required deposits, a mutually convenient date for the mediation is then scheduled.

In preparation for the mediation, we will have a brief telephone call with each of the parties. These discussions will address the overall process and any preferences the parties might have concerning the mediation proceedings.

The mediation takes place and, in the event the parties agree to resolve their dispute, the involved parties prepare a comprehensive written document, either during or following the mediation, to memorialize the terms of their mutually reached agreement.
